The Madrid Protocol – a new tool for overseas brand protection

Regulations for implementing the Madrid system for the international registration of trade marks in New Zealand are set to come into force on 10 December 2012. This has previously been untouched water for many local businesses which have been prohibited from exploring the opportunity for international trade mark registration due to the cost and complexities involved.  However, the new Madrid system provides for a more streamlined process which has several advantages both from an administrative and cost perspective.

Consumer Law Reform Bill – A step closer to Trans-Tasman alignment

The Consumer Law Reform Bill includes a number changes to New Zealand’s core consumer legislation which is intended to closer align it with Australian consumer law. On 2 October 2012, the Commerce Select Committee reported back to the House on the Bill, recommending a number of further significant changes.

Update on Patents Bill

There has been limited progress on the reform of the Patents Bill since our last article…until now.

Commerce Minister Craig Foss has announced a minor amendment to the Patents Bill on the issue of software patentability.  The effect of the amendment is that patents could be granted for inventions that include computer programs.

Natural Health Products Bill – are the proposed new regulations a blessing or a burden?

The Natural Health Products Bill went through its first reading on 15 September which proposes to set up a new regulatory system for low-risk natural health products in New Zealand.
